Well, I guess I've finally decided to throw in the towel...

We're sorting out the legal and escrow issue and if all goes well..

Even more of a shock is this scandal regarding image theft. Because of one user, the whole forum becomes involved? That's a bit extreme....

If the forum stays the same, I don't mind staying....as others have said, this is one of the most organized forums of this type available, and I think I'd have a hard time moving to a new forum.

Anyway I am sad to see this happen, and if the forum is closed/changed drastically, then I guess this is goodbye. Thank you all!

I still have last year's (or was it the year before?) SLF april fool in my bones (where we were 'excluded by forum' through a test question site before login in or else, hard to explain - the workaround was to browse the forum logged out and cookies removed, before access)
i don't even try to understand such rigide "april fools" - infact it can disturb/destroy connections to other people, think about it. *raises shoulders*

Anyway:
IF (if) this site/label will ever be sold or given away, the clean way to do it would be to remove all attachments here and clean up member base, so the new owner has to approve memberships of all or the most active members again and else ( every site i was long years member already did it this way so this would happen here first before closing - imagine that here... *sighs* ).

What brings me to another point:
What is your backup, people - where will you go if this forum will ever close its doors?
Better post it here and now, if scanlover is serious we will not have that much time and days later it's maybe too late to pick up the pieces...

Well it's more like an accumulation of things, though it has been an exceptionally rough year.

Started the year with legal letters from US studios, Japanese AV studios, amateur cam models, the usual hate mail from Women Rights groups, and angry incidents from random people who threaten legal action because someone posted their own/gf/friend/cat pictures on SLF etc etc

I guess this one from down under was the last straw for me...

For the user that has no clue (myself included) - what would be the associated costs and what would it entail to run such site?

It's about us$500 a month for hosting and bandwidth
I guess you could recover some if you place ads or join some adult affiliate programmes or ask for donations.

Also probably set aside 30-60mins a day for forum maintenance tasks (delete spam posts, comply to DMCA notices, help users activate their accounts manually because they didnt know/receive the verification signup email etc)

The spam cleanup takes up the most time, though our bunch of moderators help a lot with that. You could probably ignore most of the user requests, though when there's DMCA you will need to take action or else the web hosting company may just disconnect the servers..

There have been only two really good English language JAV forums on the net for some time. One, javtalk, is gone. This is really the last comprehensive and well moderated forum for those interested in this subject. I just want everyone to know what a tremendous loss this would be.

If Scanlover ever goes down, there won't be any sites left worth visiting. Other than my emails and work related stuff, this is the only site I use. AO has too many people posting little girls, which I don't want anywhere near my hard drive. Notchan.mooo.com seems to be gone and iiChan's bijin went down over a year ago.

Now I'm wondering if this thread is only part of the prank... let's see what happens by April 5. You know, some April fools carry on a bit to look serious.

Take a moment folks to consider, SLF is a hobby. When scannlover started it, there wasn't really a long-term deveopment plan. As we Staff Members formed, there wasn't any considerations that SLF would go on forever.

At some point, a hobby, especally one that costs thousands of dollars and extensive time and effort... must come to an end.

There's also the legal issues, and although there's ways of protecting scanlover, why run the risks? He has a family now and a business to consider. All it thats is just one of these idiots to breakthough legally and start causing hovac.

If we think this logically regarding the user who posted the pictures from Facebook, answer this question "Why does that person have access on those private pictures if he/she are not friends with them?"

Look at the comments on the link below and the answer if we think this logically:

1)They exposed these pictures on facebook and so its their fault for not being careful or set on private.If they are exposed then the intention is to show to public interest.
2) Its their fault for accepting friend request from other people who they may not know.Look at the client list with the facebook link to this matter, who has 500-700 friends and I am pretty sure they do not know all of them.
3)They clearly know and as would any reasonable person would know the consequences of posting in the internet.
4)It seems to me that the client list and John Pham are all friends.
5)The Law is in a different jurisdiction.
6)Only the user should be liable.
7)They only try to threaten as I believe due to being in state of their relationship e.g. girlfriend,boyfriend and etc.

Take a moment folks to consider, SLF is a hobby. When scanlover started it, there wasn't really a long-term deveopment plan. As we Staff Members formed, there wasn't any considerations that SLF would go on forever.

At some point, a hobby, especally one that costs thousands of dollars and extensive time and effort... must come to an end.

There's also the legal issues, and although there's ways of protecting scanlover, why run the risks? He has a family now and a business to consider. All it thats is just one of these idiots to breakthough legally and start causing hovac.

One of the biggest reasons for them 'to stand the test of time' -of those who still exist- is, that their owner is making money with them, at least enough to cover the costs.
Some even make a little money 'plus plus' with them
and all of those forums i know have moderation members who help cover the costs, if in need, additional.

yea, he wrote "class action suite" in both the letter and the fb page. the website of the law firm he supposedly works at doesnt mention his name anywhere (and a google search suggests that there isnt any lawyer in that area called john pham.

its so easy to pretend to be someone else on the internet. the fb page mentioned they went to the police and the police dont give a shit. any court would laugh at a lawsuit of this type, class action suits are very rare in australia, and certainly only apply to serious offences, not 1 user on a little forum posting pix he got from fb.

lawyers know that lawsuits should be last resort, unless they made several attempts to solve problem prior to the letter then its definitely false. also, considering the fact it probably is fraudulent, he has probably broken more laws by sending that letter than mrmovies supposedly broke.

I didn't go to law school (although i nearly did) but even I know that pics posted on facebook are property of whoever took the picture. Which means the girls themselves have no legal recourse. Whoever took the pictures ie the photographer could sue for copyright infringement.

Reading the facebook comments, it would appear that the police told them to get stuffed, not even allowing them to file a report.

Futhermore; some quick research would show that John Francis Pham is not a lawyer but rather a student of Computer Science & Technology at sydney university.

I have some sympathy with these people. I'm sure it is mildly irritating for them. But masquerading as lawyers and threatening imternational copyright suits is being slightly hysterical.

Sounds like a joke, a fake lawyer, or at the very least a very bad one.

1. Class action suits must be certified by a judge. This "case" will give that judge a good laugh. If a judge hears every case of someone posting a picture without consent, our judicial system would grind to a halt.
2. There was no mention of the damage or reason for the lawsuit. What remedies are they seeking?
3. There isn't enough legalese in the letter. "embark" and "which pertains to going against" are words used by someone in high school, not a principal lawyer.
4. There's legal precedent that websites that host material act as intermediaries. There's no way for the administrators to vet through every picture to validate their legality. The best you can do is remove offending material as they are identified. Otherwise, Google (images) would be in deep trouble.

It's #2 that makes the note unlawyer like. All lawyers ask for remedies (eg. cease and decease, financial remedy)..

It's about us$500 a month for hosting and bandwidth
I guess you could recover some if you place ads or join some adult affiliate programmes or ask for donations.

Also probably set aside 30-60mins a day for forum maintenance tasks (delete spam posts, comply to DMCA notices, help users activate their accounts manually because they didnt know/receive the verification signup email etc)

The spam cleanup takes up the most time, though our bunch of moderators help a lot with that. You could probably ignore most of the user requests, though when there's DMCA you will need to take action or else the web hosting company may just disconnect the servers..

That would seem the biggest hassle and threat to SL to me. The new strategy appears to be to go after hosts, billers, even registrars...

All the links to the upload sites probably not helpful either...they are being invaded by authorities like crazy.

I am not here to piss on the parade. I work in JAV on the creative side and believe that forums are needed for people to come together, hang out and learn and have fun. This is a great place, I hope SL works it out...There is a family here dedicated to Asian girls and I love that idea...as I am so dedicated. :)

Honestly, this so-called "lawyer" has not the faintest inclination as to how internet law operates. Webmaster, until you literally start getting C&D notices, the site can operate as-is with no changes.

First and foremost no "lawyer" in their right mind would pursue a "class action lawsuit" against some online-forum owner who: did not personally post content, ever condone illegal behavior, and who promptly addressed any claim for immediate removal. And if a case MAGICALLY ever went to court, you could literally walk in, take out a printed copy of the DMCA, and slam it on the desk while screaming "I rest my case!" And you would win immediately. "4chan" would have been dead a LONG time ago if action could be brought against you, Mr. Webmaster. (See "IO Group, Inc. v. Veoh Networks, Inc.", 2006)

No lawsuit at all and I forgot to put this in on my previous reply.Scanlover took an action against the user and content based I believe in on set of rules (correct me, if I am wrong) and solved the problem.

First of all "class action suits":
1)It applies to only specific individuals and terminology goes e.g. Minors or Disability or depending on the area of law and its legislation.
2)Privacy Law is problematic law that is not really a consistent Law (developing), I think in Australia or any part of the world.
3)An example is paparazzi taken pictures of celebs on the streets in public areas perfectly legal with analogy of cases held.Not Legal if its in their property because its trespassing area of Tort Law and then contravenes with other area of Laws.
4)I think the dumbXXX thinks its "Asian" that the terminology is pertaining to its equivalent.The legislation in austlii should say what classes are affected.

So the acting lawyer is a dud and a fraud.

Now if scanlover forum wants to bring a case for damaging reputation in Torts ,there might be an action, but I am not a Lawyer yet...so dot not trust the advice.The litigation cost are not worth fighting for.

Judge is going to have a headache putting the internet perspective into past cases.

Besides the new owner(s) keeping up the site being what it has been so far, I hope the regulars will also keep up their awesome work. Or that new regulars will jump in and help out. I know some of the admins such as Ryuuga have mentioned that they'll retire. That to me is equally sad because this site is kept up by a fine crew.

it is in a very real sense YOUR board, you are members and you are responsible for keeping it safe and secure...
please report spam and questionable posts immediately, it is your concern as much as mine and the mods/admins...
as for myself i am somewhat overwhelmed that something actually worked out as it should (fingers crossed)...

i knew nothing about it til i came back on the website, i emailed teddy and he acknowledged that he agreed, even wanted the time off as he is just overwhelmed by some major annoyances that he needs to deal with...
i told SL that he is my friend and we give each other 'chit' all the time...

As you can see, all the current staff are back into green name status. As for the remaining adminstrator and super mod title, it is a forum system glitch. The title will disappear automatically in 1 or 2 days.
